The switch though is the first logical place to start, have him pull up on the brake pedal with his food, if it goes off, it's the switch.
Well, he left the negative battery cable off all night and now the brake lights are working fine this morning. He is still planning on taking to the dealership today, since the car is under warranty.
I am posting for a friend of mine. He owns a 2010 V6 and he noticed that his rear brake lights will not go out.

We have Front brake lights too!?!?
Have him find the switch, and pull the plug on the back of the switch. if the lights go out with the switch disconnected, you have found the problem. If not, it's probably the relay.
KISS (Keep it Simple Stupid), not calling you or your friend stupid, just that it's the easiet way to root out the switch itself
I had this problem in a 2006 Pontiac G6 (i know, I know... crappy car)... anyways, after 2 attempts by the dealer to fix it, they finally figured out is was a relay. That said, this is an apples to oranges comparison, but it's definitely something electrical. Did he say he had a water leak in the passenger foot well or are you just thinking out loud?
Since the car is ~3 yrs old, is it still under warranty?

i did have a water leak in passenger side. What would be the solution to the brakelights?
