So, the rear tires are 0.8% larger diameter than the front. This is close to the 1.0 to 1.5% that is known to create problems, and could be enough for the ABS to disable itself.

Is the ABS lamp on? Does it prove out (come on for a few seconds) when you first turn the key on?
No the ABS lamp is not on and yes it does prove out. Now thats it is much colder outside I can feel more wheel spin with traction control off.. I think perhaps I just had limited wheel spin to begin with and the traction control did its job smoothly.

Summer tires? This could effect traction.

Yup, it would make it a whole lot better... I run Falken RT-615s:

With a treadwear rating of 200 they stick like "it" to a blanket--don't last very long, but they stick...

I wanted to see what traction contorl does as it's so fast it's hard to see.. @ 3000-3500rpm it retarded the engine as i could hear what sounded like spark knock.. it releashed @ 4000rpm and kicked back in @ 6500 rpm when it changed to 2nd.. my speedo is 10mph to fast.

I noticed yesterday that the word "off" was lit up on my TC button. I pressed it and nothing happened. It is still on. I don't notice anything different when driving. Is this something I need to address? I found nothing regarding this in my Haynes manual, not that that means much.

This means either the switch is defective, or traction control has been permanently disabled in the tune...
