Default Legal or Not?

I was on my way to work today and spotted a Gt for sale at a used car lot. I checked it out, SUPER clean. I check under the car and noticed the O/R H pipe. Now we don't have emission testing of anykind here in florida but it is still illegal if you do somehow get busted. My question is can a dealer legally sell a car they know is emissions illegal?

Also on a side note, I'm curious as to what other GT owners would offer the dealer for it. It's an 04 Silver gt with 50k miles, 5 speed, MACH 460, black leather interior flawless, silver exterior is in great condition with only 2 knicks on the front bumper. It has 18" Chrome cobra rims all around, lowered about 2 inches. The dealer wasn't open yet when I stopped so I have to go back in a bit to get the full list of mods.

yes a non-catted vehicle no matter where you are in the us is illegal. It is a federal law. Now, will a officer look under your car...probably not, but they can and they can fine you. I don't have emissions testing where i live either but it is still illegal to not have cats. As for the price of the car, this is a buyers market. use that to your advantage and negotiate. good luck!

lol you went in a circle man. i already know it's illegal. I was just wondering if it was legal for the Dealer to sell me, or anyone else, a car that is currently emissions legal.

It really depends on the dealer. If its one of those "buy here, pay here" type places, then they would probably make you sign a waiver and tell you its your responsibility to get it corrected. If its a larger dealer, then the car probably wouldnt be on the lot until the cats were properly installed.

makes sense because if you got busted you could pin it on the seller saying "the company sold it to me like this and I didnt know"

i am from florida and ive seen a couple of vehicles for sale at dealerships that have no cats on them. i guess its one of those things that they can sell you a vehicle with no cats, but if you get pulled over and get a ticket for it its on you and the dealer is not responsible....thats just what I think.

my understanding is that as long as the dealer didn't do the mod, they can't be held responsible for it. So if the car was traded like that, they are not responsible to put new stuff on, unless you would have emissions testing it would need a new sticker, then they would be required to put it on in order to pass the emissions test.
