no it is not pulling any codes and I did do a vacuum leak test with a smoke machine.
I deleted all the emissions solenoids and lines kept egr and ran new lines for egr.
the tuner I use has burnt a chip for it, which is a diablo. the car has E303 cam,
with xpipe using stock intake and plenum right now. could that be my problem?
and also using stock heads with some work. in park idle is about 850 rpm

No the stock intake wouldn't do it. Its getting into the relm of something your tuner did to it. I guess the way to find out is pull that chip and run it stock ecm . See if it clears up. If so its in the tune.
I think I have read some where a bad torque converter can cause surging at idle when put in gear. Id have to do some digging to see if I remember that right or not. though. I may be mistaken but it seems I read that someplace before.
