Yes, The C&L DOES require a tune.
Two ways to check if it's installed:
Drive it and wait for the check engine light
Have the dealership service guys confirm if an aftermarket tune is in place.
Another issue is that if the dealership knows nothing about the car, exactly WHAT tune is in place? Is it tuned for 89 octane fuel? 91? 93?
Without the tuner included you also have no way to return it to stock should you ever wish to change out the C&L short of paying a dealer to reprogram the ECU.
That being said, the C&L IS a very good intake on the 4.0L. I had several N/A intakes on my car while I was waiting for the X-Charger to be released, and the C&L was the best, no question at all.
