"Trac Off" button confusion

This is a little off topic, but, if you were to get into an accident with TC off, would that be similar to contributory negligence. (Like, if you get into an accident while your seatbelt is off, you contributed, you have more responsibility, eg, someone hits you and you get hurt, but if you have to sue, you might be ruled to be 80% responsibly because you had your seatbelt off.)
I guess you should also make sure you never turn off that rear camera gizmo, if you have one, just in case you do accidentally run over the neighbors baby backing out of your driveway!!
