Yeah, looking at it again, she should be ticketed for failure to yield because i would bet the sign hanging above the turn lane says "Yield on Green" So, if they wanted to, they could give her a ticket. I personally wouldn't if I was on scene because then that would allow the family of the thief to sue her for wrongful death or some bull**** like that versus her just being at the wrong place at the wrong time.
Can't she can be sued for wrongful death either way?

I dont think the van driver should be charged at all. They probably glanced and saw the truck a really long way off and assumed that it was traveling at a normal speed. Therefore there was no need to yield. If it was a normal situation then they would have had plenty of time to turn.
Granted most of us probably would have taken a closer look and not turned because we could tell it wasnt a normal situation.
