They knew it was in the road for an hour and no one retrieved it? They probably wanted to see the destruction.

That was my thought too! I'm the type of person that if I hadn't hit it and I saw it in the middle of the road, I would have pulled over and put it in a grassy section in the parking lot so it couldn't roll anywhere. I found it quite ignorant that they left it out there awaiting damage.

I'm lucky it wasn't standing up when I hit it because at that speed it had the potential of going in the air and over the roof...with my top down I could have gotten seriously injured!

Yeaahh... good luck with that..

All Im saying is - you hit the cart, the store didnt hit you with the cart. You should have been paying attention. My mothers Mercedes got blasted by a cart a few years back when it was windy. Know what happened? Nothing. I ended up pulling the dent in my garage.

you must be missing the part where it was out on a public road and not sitting on the store's property in the parking lot

if it was me, i wouldnt be calling insurance at all....even with a good deductible, it would probably still be cheaper to fix that himself... looks like he just needs his bumper repaired or replaced...

You do realize if you take this to court the shopping center(most likely a chain) will hire a six figure attorney and rip you a new one in a court of law, right? During a recession like this, they won't be likely to roll over very easily.

I think your best bet is to take your pictures, damage estimate, and any other supporting documents to the owner/General Manager of this store and explain your story.

yea...theyre so pressed for money, instead of coughing up $400 for a new bumper plus paint, they are going to hire an attorney for 1200 bucks an hour and fight you!

if he even breathes about court, i would be willing to bet that the store settles...bumpers arent very expensive, but going to court is...plus, what company would want that kind of bad publicity over something this small?

Attorneys are cold blooded mofos. I bet the attorney would even go as far as accusing him of reckless driving.

99BlackPony, big companies like Wal-Mart and Kmart have 24 hour lawyers that are on a salary; all they do is go from place to place winning cases against their companies. And the only chance there'd be negative publicity over something like this is if the OP went around town/newspapers getting his story out.
