Default HIT A SHOPPING CART IN THE MIDDLE OF THE ROAD!!

I was driving down the street with my friend, heading towards the beach. As I'm going along I slam into a shopping cart at about 35-40mph! The cart was black and on it's side in the street, I couldn't see it because it was night and on the blacktop. It really did a lot of damage.

When I went in to tell the store they said it's not their problem. Thank god I'm studying law and know my rights! I'm going to give it to them hard for their arrogance! Another store in the parking center said that cart has been in the middle of the street for an hour or so, and its been hit by multiple cars until it finally was put on it's side. That's when I came out and hit it.

I'm tired of the arrogance of these stores thinking they can own these shopping carts but have no responsibility for the damage they cause. If that cart would have blown the opposite direction another 100 feet it would have been in the middle of our highway with 55mph+ speeds and someone would have been seriously hurt! This has got to stop!!

HAHA! Yeah it does suck. I can't really go to the car shows like that now!

i would believe it to be the stores fault, it's their responsibility to keep the cars in designated areas. I am pretty sure it being in the middle of a public street is a violation on their part, seeing as its a felony to take a shopping cart off of the stores property line.

I hope your joking. Contrary to popular belief it is negligence on the part of the grocery store for not properly containing their shopping carts. Had this happened on private property it would be harder fought, but since their cart came out of their shopping center and into the middle of a public road it immediately becomes their fault, and clear negligence on their part.

Secondly they don't have any reflectors on the carts so that is a definite issue.

Thirdly the carts are painted black which don't reflect any light like standard chrome carts would. This sets the store up for further negligence claims.

Fourth they have zero shopping return sections in their parking lot.

It's my fault a shopping cart was in the middle of a public road?! It's my fault I didn't see a black shopping cart on its side, on black pavement, with no lighting because it's next to a cemetary, and with no reflections because the carts are black with no reflective paint or reflectors?! WOW! PLEASE STUDY LAW BECAUSE IF I HAD TO GO AGAINST ATTORNEYS WITH YOUR MINDSET I WOULD ALWAYS WIN!!
