It could, as long as it is off in the right way. You could say, according to your speedo, you were only doing 2-5 over, not 10+ like the officer states. But, I would bring into play his credibility. If you couldn't see him pacing you, how can you believe he actually was and just didn't nail you when you passed the truck? It is like truckers say, if you can't see me, i can't see you. I would challenge his position to pace you as well. I would also say that you were only speeding to make a pass because the truck was doing 40 in a 45 and you planned on slowing back down after passing. Then on your way out the door give the cop the good ole . Followed swiftly by a swift kick to the nuts

Are you saying that it is legal to speed while passing another car? I wouldn't go with that defense if I was the OP...

pacing is the excuse cops seem to use when they want to pull you over for speeding, but have no ****ing clue at all how fast you were going.

Yeah.. it will help you get a ticket for equipment violation. would be a non-moving violation so could help with insurance, could cost more than the speeding ticket though. My sister got a ticket downgraded to equipment violation.. she was in.. Missouri i believe at the time.. did something like 85 in a 65 in a rental car.. apparently that is a big fee/jail time there so she hired a lawyer to get it knocked down.. that was one expensive ticket..

when my bf got smaller wheels on his truck and it changed his spedo and he got pulled he told the cop that, and the cop wrote him the ticket and said if he came to court showing an invoice that he got it fixed hed drop the ticket, and he did.. so i would take an invoice from the guy that calibrated your car saying that its now fixed and go to court and explain that and id say youd have a 80% chance on getting it dropped

In CA (Cali) where he got the ticket CHP is certified for pacing and about 75% of city beat cops are trained but not certified. The pacing courses and training is a requirement in most CA municipalities.

At 10mph over in traffic, the cop would be very hard pressed to prove he could accurately pace you. Certified or not.

Not legal, but that he wouldn't have to speed that much when passing a car going below 40 in a 45. it would be different if the guy was doing 45 and OP passed him, but he wouldn't have to speed 10+mph over to make a pass on a slower moving vehicle, that would mean OP sped up ~15 mph to pass, that seems fast to me.

Too bad you are in Cal. I know a good speedo cal shop in Dallas off 75 past Beltline Rd. They charge $50 to inspect and it is court legal. Now the ticket may only cost $50 so is it worth it?
