Default I got pulled over today

I was on my way to work today when I noticed this truck infront of me kept moving around 30 mph. The road posted at 35 mph and this truck kept going slower and slower....The truck finally pulls to the right lane and I gave my car a little gas. I noticed my speedometer go from 30 to 40 mph. I let go of my gas so I can slow down a bit and out of the blue, I see a police cruiser flying around the cars behind me. The police officer gets right behind my tail and turns on his lights. I pulled over and rolled down both my windows for the officer's safety. The officer asked me what was my rush and I told him I was trying to get to work. The officer gets my drivers license and paperwork and returns back to his car. 4 minutes later, he comes back with a ticket pad and pen. The officer advised me that he could have got me for several traffic violations. He told me he will drop the charge for tailgating but he will issue me a citation for excessive speed. I asked him how fast I was going and he states that he paced me for 4 blocks and states I was driving 45 mph. I asked him how much the ticket is going to cost and he states that the county court will advise me via mail. I signed the ticket and I recieved my yellow copy of the ticket. Before I can ask the officer if I can see his radar gun, he walks away and tells me to pull safely back into traffic. I know I went 5 miles over the speed limit but i swear I never went to 10. Is there anyway I can fight this ticket?

pacing is such a crock of ****,i had a cop once pull me over out of his jurisdiction, give me a ticket claiming he paced me from like 12 15 car lengths back, wrote on the ticket that he pulled me over 2 blocks back into his jurisdiction, so i went to court ready to fight his ass and he never showed up so i won, i had history with this same asshole b4 so thats prob y he was an extra dick 2 me, and wen he asked 2 search my car i told him no and he got pissed, bc ive studied CRJ and know the law and there bs scare tactics

Well.. I dunno about CA but a cop claimed to have paced me.. even though I was doing 40 in a 35 in my old grand am.. he said i was doing 55.. I told him my speed-o must be off by a long shot then.. he let me go with a warning.. best bet.. whats the hurry? I've gotta poo. I think your only option is to show up in court, tell the judge you were watching your speed-o, you believe its been properly calibrated and it said 40 in a 35 and you are willing to pay the fine for 5 over the limit unless the officer has evidence that you were going faster in which case there is also an instrument failure or something along those lines case..

easy to fight if it was paced

demand the officer certification for pacing through the freedom of information act, if the PD can not produce the documents then motion to dismiss

Thanks, I'm going to fight this ticket to the bitter end. Im going to see the guy that tuned my car tomorrow and see if he can help me with my calibration on my cluster panel. I think the police are out in full force this memorial day weekend cuz i have never seen this many cops roaming the area and pulling people over.

I don't understand where the rumor that the cop has to: Use radar/laser to issue a speeding citation; and, has to show you said gun came from...

Pacing is perfectly legal, he will win if you fight it unless he doesn't show in court. A his word versus yours kind of thing. Why are you fighting the ticket anyways? You admitted you were speeding ~10 MPH over the posted speed limit. Fines for speeding are generally in brackets such as: 0-10, 11-20, 21-30 over and so on.

Talk to BleedinBlue for confirmation of said gay rules and stuff.

Just take Differed Adjudication and keep on keepin' on.

EDIT: Just be lucky you didn't get a real prick cop. Some guy that was supposed to go to a hookah bar with us got pulled over for 95 in a 35 when he exited a highway.

Now, he is f'ed in the A on sataday.

it is rare for cops to be certified in Pacing nowadays this was the reason for my suggestion to request his credentials to do so. it might be legal doesnt mean hes certified, same with a laser or radar gun you must have current certifications to use them. else it would be like you turning on the machine and writing tickets without the proper papers :P
