I did traffic investigation for 6 years, and never saw a case where a driver was found at fault for having darkened taillights. In any event, the officers responding would more than likely (in most cases) find the driver that actually caused the MVA at fault, (in this case, the driver who rear ended the car with the darkened tails) and cite them with "Following too closely", or another similar statute, as it is ultimately their responsibility to stay at a safe distance in the event of a crash in front of them.
FWIW, most states also only have specific laws about light output (the light must shine through, Y in color and at x amount of feet), and most officers (that I've dealt with, and I was on one of the largest traffic units in the state) aren't going to make a big deal about it, unless you are asinine.
