Got hit...need advice again
#11
And here's what happened: Two-way street, wide lanes. Girl was in front of me going to make a left onto another street and was all the way to the left side of the lane. I was behind her and to the right. As she went to go left, I went to go right, and she decided that she would go right instead. So I stopped before my turn, honked the horn for literally 5 seconds and she continued in her path and ignored the horn and hit my left front fender, denting it and rubbing her **** red paint all over it as well as ****ing up my bumper. I don't know which way insurance is gonna say it, but I have a bad feeling they'll claim it's equally my fault for not waiting for her to completely make her left, but IMO mostly her fault.
Advice?

It sucks but on a single lane road (one in each direction) it is illegal to pass on the right under any circumstances except for incase of an emergency. Even then, that 'emergency' better be justified.

Yeah...sorry but I agree with the cop. One lane traffic you should wait your turn. I was turning left at an intersection on a two way street and there was a car coming towards me doing the same. We both wanted to turn left across traffic and both had our blinkers on. You guessed it, we each had people that were apparently in a bigger hurry behind us. Before either of us could complete our turns they both passed us on our rights. If either of us had initiated our turns we both would have crashed into these guys or they would have hit us actually. If you're in one lane traffic...keep it one lane. Major peeve of mine lol.

Well their insurance and her are seemingly going to win. I believe we are equally at fault but in the eyes of the law if one thing supersedes another, you lose.
What gets me is she was a permit-holding drugaddict girl that didn't even have her permit on her at the time of incident. Some dumb young girl. If it was anyone else, they would have realized the situation and prevented it.
Looks like I'll be paying out of pocket for what is hopefully a new driver's side front fender and paint and a respray of the bumper.

Maybe true, but what does that say about you putting yourself in that position in the first place.
