How can you tell if the performance tune is still there or the factory tune, after a battery disconnect, I think is what is being asked

You can retune it to be sure. It only takes 5 minutes. My question is since you tuner is "paired" with your car, since I think it does revert to factory tune, does it just connect and ask to download the original tune again or can you just install the custom tune right away?

The tune will not revert back to stock when the battery is unplugged. If you want to reload a tune it works just like it did when it was loaded the first time. You do not have to go back to stock or anything in between.

Everyone is correct that the computer does not loose the tune, but being the computer geek I am, I feel a little lesson in why could be useful.....There are two types of memory out there (volatile (RAM) and non-volatile (hard-drive, CDs, thumb-drives, memory cards)...volatile loses everything when the power is shut off....non-volatile DOESN'T....The tune is written to a programmable ROM, much like your pictures are to the memory card in your camera....you can't loose them unless you physically delete them....hope this helps to explain what is going on behind the scenes a little....
So whatever was on the computer when the battery was connected is still on it after it is disconnected!

To address the question, no you do not lose your tune if you disconnect the battery.
