Update:
Brent did respond to my email and stated that the tune I have turns off the 02 sensors. He said he could send me a new tune if I wanted, but the I already had the CAI off... so I replaced stock airbox, disconnected the battery for a couple of hours, reset to stock and put on 50 miles to ensure there was a new OBD history for them to see.
Final result: passed the various emissions tests.
This weekend I will put re-install the CAI (its a snap now that I have done it a couple of times) and the 93 tune. ...a good excuse to drive it, ya know, make sure everything is in order an all......
