A cold air intake doesnot damage the engine but may lead to certain problems that will hinder performance. Newer cars are able to inhibit/fix themselves to a point to prevent serious damage from occuring (knock sensors, egr, etc.)Primarily a CAI will lean out the air fuel ratio especially at full throttle from a dead stop/drag race. When the demand for the higher airflow is needed at 4500rpms the ratio will return to normal 12:1-14:1. That is why you need the tuner to add more fuel throughout the power curve (midrange) to bring the air/fuel ratio down from 18:1 to a performance orientated (12:1-14:1) ratio throughout the entire band.
However, there are other factors to be taken into. As some consider a 12:1 ratio to be rich. But it depends on the dyno numbers as engines vary from each other.

i installed my BBK 'CAI' along with my LMs without a tune and ran my car as a daily driver for 3 or so weeks also without a problem before getting a tune for it. i never worried about my car going into safe mode or thowin a code. just me though.
