Yes, if it is flat, won't hold air, is bald, the sidewalls are toast, is rubber rotted, is past it's expiration date, is bulging, is unevenly worn, the radial belts are exposed, the tread has separated, or the tire is made in china (Chinese tires do not meet minimum USDOT regulations).

Not meaning to thread jack but where are the experation dates on tires? Curious cause the tires on my car where made 44th week of 2004 not sure if that's an issue, they show a small sign of dry rot and was curious if I should raise a sign to the dealer I bought it from.

There are no expiration dates on tires - just manufacturing dates, as you stated. I'd be nervous driving on a 2004 tire only if it was on a daily driver.

Its my daily driver now but i have no clue how many miles the original pirellies are good for but the car has 40k so that would mean 40k on the tires and they have a fair amount from the bar maybe another 10k on them. Well thats without doing any burnouts or anything fun.
