+1 when the car has converters all the adjustments are still made before the converters (by the upstream o2 sensors) so there is absolutely no difference with an O/R midpipe. So you like people have been saying the past few posts you're probably not running more rich than you were with the stock midpipe.

It may be something the newer ('05+) PCMs do, thanks to the EPA and Congress engine control systems keep getting more and more annoying as time goes on...

there is definately a hesitation, and i can smell the excess fuel coming out the exhaust. Even when cruising, say at 2300 rpms. i can feel the car surging for air/fuel.

The MIL will come on, but its not on every day and ill just reset the computer and all w ill be ok for a week, but even with the MIL reset it runs the same hesitant way.

If your car is running sluggish check the plugs, wires, and coil packs. Also run some sea foam through the gas tank, and see if that clears things up. And there is no "safe mode" for the Cats being off the car.
Does the MIL flash at you when it comes on or is it on the hole time? Quit reseting the computer and see what it does for the week.

its not spark related. Started doing this right after replacing the pipe.....no cats.

I forgot to include that when hesitation exists it will sometimes go up to 2000 rpms' and even though my foot is on the gas(or i mash it) it will still hang at 2000 rpms then jump up to (3000 rpms) reacting to my foot, but it is a delayed response.

Oh, and it stays on all the time, no flash.

Everyone with an O/R midpipe has that smell (and BTW to me that's a positive thing) because you don't have converters anymore. There's no more converters to capture the excess unburnt fuel.

This doesn't mean you are running rich it's running the same as before more likely than not.

I really doubt you are running rich but if you have a handheld tuner you should tune for the O/R midpipe just as you would for a cold air intake, catback, etc.

Have you thought about checking the MIL to see what code it's throwing? Could solve some of the problems. How do you know it's not spark related? I had a bone stock 87 5.0L changed the exhaust out, and had a problem similar to yours, turned out the TFI module on the distributer went out.

It could very well be one of your front O2 sensors crapped out. When I installed an o/r x a while back...I accidentially dropped an O2 sensor and it broke its internals. If you were running fine before then, look to your front O2 sensors. The rear O2s would not trip out the vehicle like that.
