ok heres the story last week me and my family checked out this 00 procharged gt which was selling for a good price we make a deal with the guy we put down a deposit and in a week we were going to pick it up and today i get a call from the guy telling me he has bad news ... which i was think it mightve got broken into.., but that wasnt the case .. what really happened was he sold it for a higher price his excuse being he wanted more money but we already commited by depositing money... no my question is... is that legally right? i cant do anything anymore about getting the car its obviously sold but my intentions arent sueing him but this is really bs....!!!!

unless you have an email from him specifically saying a price that was agreed on, then there is nothing. I'm sure you didn't have a contract written up for this car. Email are seen in court as verbal agreements. So if you have an email that says he is selling it for $12000, and you can show replies that back up the fact that the price was agreed on, and that a deposit was made to secure the deal, then it will hold up in civil court. Although I'm sure the judge is not going to take the car away from the other dude and give it to you. The only thing you would get out of it might be some sort of compensatory damages because you got psyched up about it. Its more hassle than its worth in my opinion...

i would be sure to get my deposit back for sure. If he doesn't give it back, then take him to small claims court, and make sure he has to pay for the money and attorney fees(you sue him for that)
