I'm sure both units have a number/figure stamped on them that would help determine if they are standard OEM stuff or aftermarket but if you are going to get under the car to look it would also help to have a gameplan too.
I'm not really sure what the problem could be but if it happens only when you have people in the car maybe it could be suspension related. Is the car lowered? Are suspension components like the shocks/struts, control arm bushings etc. in good condition?

salvaged car due to front end damage on drivers side! Car is lowered only from the front, but cant see that being the problem since i still need back lowered, kinda how car lowers when people are in car so if i was to lower it from the back wouldnt it hit more..., thats what im thinking..!!

No fat asses, no offense....lol. Im leaning twordes the tranny mount along there as the problem!!

Only a wrong tranny crossmember / hugely oversized tranny bushing would do that. But even still... a lot of people, including myself, run aluminum driveshafts which have a larger diameter than the stock steel driveshafts and do not have this issue. Something else is at work here, I think.
Is your floor dented/bashed up? Are you sure a shoddy exhaust isn't hitting the driveshaft? How do you KNOW that when the car is loaded with passengers(and I'm guessing you're not underneath to see, at this point) that the driveshaft is the problem? Can you see wear marks on the driveshaft where it is rubbing?
