that should be covered. you make a big deal of it and it will be, some things are worth fighting for. now if it looked like you drove with chain male gloves, maybe different. but you say its at 12 oclock and is split, sounds like the hot sun did it's thing and the leather was ****ty. once replaced definitely condition it, I like neatsfoot oil because it doesn't have any synthetic crap that may do more harm than good.

Update: I went in between Christmas and New Year's and got this looked at, they covered it under the warranty.
