Default Aftermarket parts and Voided Warrenty

I see a lot of people talking about voiding the warrenty with aftermarket parts. Which brings me to this, has anyone heard about the Magnuson-Moss Warranty Act of 1975?

This make it illegal to void a factor warrenty due to the installation of aftermarket parts. Dealers must prove that the aftermarket part was the cause of the malfunction.

Obviously, the #8 cylinder misfire- more than likely is due to the tune and that provides an exception and a valid basis to deny warrenty work. The simply installation of the parts does not create a void. It's the possible malfuntion of said parts providing there is proof that those parts caused the issue that would create the void.

Thoughts..

I think the majority of people are aware of the whojamawhatchit act. The problem is what is the burden of proof that is necessary on the dealers part? If a Ford master mechanic says the tune caused the failure, then that's probably proof enough.

I agree it looks good on paper, but unless you are a lawyer or have a friend or family member that is it will probably cost you more to fight Ford in the court system than the cost to repair the part out of your own pocket. I’ve known a few people and read even more about Mazda (no Ford experience) voiding warranties for aftermarket issues and they all screamed “Magnuson-Moss” but I never heard of one winning the battle, reality bites!

I heard that if you put anything besides BP fuel in the car (which is what Ford recommends; look at your gas cap), that you void your warranty AND waive the right to bear children.

Or put in only Motorcraft oil! Kidding aside...

Some dealers will try nearly every point possible to avoid warranty work due to a failure on a modified car... even if that car had an axle back exhaust which miraculously caused a MAF failure . But others will look the other way and have no care in the world.

This is true, but there would no reason an exhaust system should jeopardize a warrenty
