Even though the tail lights are blacked out, the 3rd brake light isn't. If I get rear ended, it won't be my fault.
I've always had my tail lights/ head lights blacked out, in the 4 different vehicles I've owned. No one has even given me any problems, no tickets, and I've never had an accident.
The fact of the matter is, you CAN see through the black, even in broad daylight, so if someone hits you, they weren't paying attention.
