As long as you can pass the OBDII check you'll probably pass. Technically any aftermarket cam is not emissions legal since they did not go through the process with the EPA and all that. Plus a high duration cam does let more unburned gas escape which I'm sure the EPA wouldn't like either. 
But I doubt you'd have a problem. In Cali it may be a different story since they're freaking emission ***** over there.
