Default conract question

i was wondering, i ordered my 05gt 2/11/05 and still clear and unscheduled as of today, my contract says delivery of car will be by 6/30, so what happens if i dont have my car by then? do i just get my deposit back? i am trying to remain optomistic about getting my car but after reading about all the people who have ordered before me and still dont have there cars, well i am doubtfull i will be getting mine. i called the dealer today and asked them what was going on with my order and he told me that they know nothing. they call everyday and all cars are still no schedule date, they have 6 on order. it really sucks because i cant do anything about it. the dealer told me that they are waiting for an answer about the delivery of these cars so they can tell there customers something at least. this really sucks a$$. i am under the impression that 06 production begins in aug. so maybe theres still hope. 2 more months of 05 production left, or 3 if its the end of aug? does anybody know anything about whats going on with outstanding orders?

I went and got my deposit back after I purchased another GT that fell into my lap. They gave me the deposit without any questions. The dealer also showed me a letter from Ford telling them many of their orders may not be built in 05. Ford's letter stated the dealers should tell the prospective customers they may have to wait until 06 to get the car they want and would have to pay an increased cost as there wouldn't be any price protection carry over. The car I ordered on 1/15/05 was still clear and unscheduled as of 5/5/05.

id either wait it out and dont get the deposit back because when i ordered mine the $500 i put as a deposit went towards the car anyway so didnt matter..i got my car in about 5 weeks...its awesome..i'd either wait it out or cancel...if it takes longer just save your cash and put more of a downpayment down

On your V.O.C. does it say anywhere that the deposit is non refundable? If so, you probably won't be able to get the deposit back until after the promised delivery date. Once that date has passed, they have breached, and you can request the deposit back and they have nothing to argue about. Don't get me wrong, you can ask for it back before hand, but IF it said anywhere on the V.O.C. that it was non refundable, they don't have to give it back to you until the deliver date passes.

I ordered around the end of January. At first they told me 4 weeks. Then the day the order placed, they said 8 weeks. After 6 weeks of being C/U I started shopping around and found the EXACT car I had on order at a different dealer. I called the place I had my order at and tried to get them to do either a vehicle swap or a dealer purchase, anything to give them the sale. But they had no interest. They told me the time had increased to 12 weeks, and also said I could go buy a car anywhere, if I had found what I wanted. BUT, no deposit refund until after the promise date. So I went and bought the other car. The second dealer in fact gave me a better deal, threw in some extras, and more than made up for the deposit ( if I lost it ). 12 weeks and 1 day after the initial order, I drove my new stang to the lot I had the order at, walked in, requested my car. They scrambled around for about a half hour, then the inventory manager came up to me and said that the car was still C/U and said they could do nothing other than offer me my deposit back. Which I gladly took.

Bottom line, I would let the deposit sit there and not worry about it until after the expected delivery date. You may not be able to do squat about getting it back until then anyway. In the mean time, shop around. If you find what you are looking for somewhere else, weigh out your options. If you can put yourself in to a good enough state of mind to purchase the vehicle and not feel bad IF you don't get your other deposit back ( like a miracle would happen and your order come in ), then buy it.
