I've never bought from a private party but my understanding has always been that the seller pays the sales tax. They are not allowed to keep that money so what they often will do is build the sales tax into the price. For instance, they want $500 in their pocket for the car, sales tax is 6%, so they would sell it for $530, and they are responsible for paying the $30 to the state. I could be way off though. correct, TX does not have a state income tax but sales tax is a totally different thing. When we bought our 65 coupe from an individual we payed a percentage of the purchase price (which like Randy said goes by what the seller reports so you can sometimes save a little there if the seller agrees =). )

That's what I though, and I know that they are two different taxes but by clarifying one it would make it easier to figure out if TX charges Sales tax. AZ doesn't charge Sales tax for private parties but then we have income tax.

Yep, makes sense. In some states you can save by not having to pay a certain tax but they may also have taxes that other states don't. I wonder if Georgia has state income tax? Cuz that would be unfair if he does not have to pay that either! =) j/k
