Is Sales Tax Refundable???
okay, thepartsbin.com is screwing me over on an RMA i think....i bought a junk radiator, returned it, now its gonna take 4-6 for a refund of just the parts....they say they dont refund sales tax....its like $20 tax so i want it back....
if i were to buy clothes at a store or something and return it, i get the tax back, end of story....whats the deal? they told me its their company policy to not return sales tax...is this even legal?

Tax is part of the purchase price it should be refundable. Ask them for a copy of their return policy or where it states in it that they DO NOT REFUND TAX. If they can't provide that to you, then tell them you will be filing a complaint with the BBB in their state as well as your local one.

okay, well i got completely blown off by these people and they refuse to give me back my $13.92 so i reported them to the BBB and hopefully that will do something. Its not much but its the point, and they are practicing illegal and shady buisness. The part was crap also by the way...lol

From what I understand, California is trying to collect state sales tax on internet transactions involving California resdients even if the business is out of state. The way I understand it, it's only illegal for them to charge you California state sales tax if you're not in California and/or they are not turning the sales tax over to California. Not refunding the sales tax is absolutely illegal. I would start with the California State Board of Equalization, the agency that enforces the sales tax collection in the state. I'm sure they would be very interested in a company collecting state sales tax and not turning it over to them. Just an idea for a way to make these cheats' lives miserable.

Now it is wrong for them to charge Cali tax if say you ordered from Idaho, and their wharehouse is in Texas. Most places charge applicable taxes that the state where the goods are being shipped. IE: I order from Cali from an Oregon (sales tax free) wharehouse/company and I get charged Cali tax cause thats where I live and its getting shipped to.
