Default one thing after another...

my car has been in the shop for 2 weeks now. they manufacturer left a peice of a tool in side my tranny so that had to get replaced and it took for ever. the rental car they gave me got hit and ran and i had to pay for the damages and then the morons at the stealership LEFT THE DOOR OPEN in my mustang over night and it poured all night.. there was sitting water on that side of the car, the shaker500 sub and speaker on that door do not work. my custom floor mats are soaked, the power seat no longer works plus the guy said my car will probly be marked as water damage car and it would show up on carfax.

Wow, what was the dealerships response. It sounds like they have been negligent at the very least.

they said they are very sorry and they are going to give me some sort of discount on non-warranty repairs. but i probly wont be using that since i know of better mechanics and cheaper prices

dude...that so sucks..... unfortunately they are probably only responsible for fixing what was damaged....

I think they need to compensate you a little more then a "discount" on non-warranty work. Thats just a pig and a poke! They mark it up and discount you to the original price.
They obviously need to make you whole agian in regards to the car being repaired completely (carpet replaced, seats fixed, stereo speakers replaced, etc.) and after they have done that then you need to be thinking about taking any further action. In the case of negligence "sorry" doesn't get it done. They need to own up for what they have done and make the necessary reperations JMO.

well what do you suppose i ask for? a totally new car? i was thinking about demanding it. or perhaps a free install of the body kit im buying?

Unfortunately a new car may be a reach. While it is obvious that their negligence has done damage to your vehicle and they need to fully repair the car ( I am assuming they offered to do so) they have also done significant damage to the resale value of the car due agian to their negligence. I think the reperations should be negotiated if what your looking for is them to install a body kit then fine. However, I would start with getting them to agree to the fact that their negligence has caused harm to your resale value, then go from there.

Show up as water damage on CarFax? I find that hard to believe. It will only show up if dealer reports it as such. I would shoot for new carpet, new upholstery, new mats, new door wiring, new door panel and speakers, and if it was the passenger seat tell them to convert it to a power seat while they have it apart for new upholstery if you don't already have one. And if they do report to carfax ... tell them you want a couple of Grand Cash for diminished value!

they told me they will have the fan inside and on the door panel all night and that they will replace sub and speaker. thats all. they said they are some how using liability insurance that they have for cars in the shop that get damaged to pay for the repairs and that the insurance company reports it. i dont understand why they need the insurance company. i couldnt really understand the guy on the phone. when i go there tommorow morning, i will get more info.

They are filing a claim under thier GL (General Liability). They will not be paying for any of the work their insurance will. Whether their GL insurance would report something like that to car fax is a little questionable. I would also wonder what their deductable is that they would file for such a minor amount. If they are not prepared to replace and repair all of the damage in this instance then you may be well advised to seek the services of a lawyer. I am not a proponent of using the legal system in most cases but it does appear that this is a case of neglect on their part. You should be made whole for your loses and it does not appear that will happen.

I would talk to them tomorrow agian to discuss the work they propose to do to resolve the issue, remember to mention the fact that due to "their negligence" you have been harmed financialy. Suggest that at the minmum they should repair and or replace all the necessary part and that you need to be "made whole" in this matter. If they do not agree to repair all damage at the minimum be prepared to ask them to wait while you consider your options (do not threaten a lawyer until you've actualy talked to one). Do not agree to anything you are not comfortable with, with out seeking the advice of a lawyer. Once you have left the dealership cantact a lwayer to discuss your options.

It may be a case where the cost of the lawyer outweighs the damage. However, this may be close and worth looking into.
