Look online at your state's emission requirements.
Where I live, they do a OBDII test and with the newer cars (including s197's), you can have at most 1 'Not Ready' tests and the check engine light must be off with no codes.
Plus visual inspection of course.
Having a CAI itself is legal; you get into problems when your rear o2 cats are turned off in the tune and a OBDII test is performed to check the diagnostic systems.
