I'm in the lovely Montgomery County...Yea! I am just going to take it in, and see what they say...I'll keep y'all posted...Not sure Bren shut down my 02s, as I only have a CAI & tune...everything else stock...We'll see...

If you have a hand held tuner, most of them act as code readers, no? You should be able to pull up the OBD sensor status on it and find out.

well, thanks again Koto...I'm a lot of things, but handheld tuner guy is not me, but I'll poke around with it this weekend...I got the Bren 93 tune in her and never did a thing witrh it after that...

I have fiddle with it, and although not an expert, I am almost positive you cannot tell from your (SCT) tunner if the cats are on or off on a custom tune. You can modify an SCT canned tune though which may be another solution for you. You need to pick your cai, and from the options menu choose the O2 sensors on. It is very easy to call bren and ask him if your o2 are on and if not he will email you another tune..

May be easy to call Brenspeed getting an answer is another thing. Took mine in for inspection and was getting o2s not ready after running my car for 150 miles on my supposed BS emmisions tune. I sent an e-mail and called and asked and they were less than helpfull. I would think you can open the tune you sent me and verify but this guy was wanting to charge me and told me if I ordered it with the rear o2s on then that is what I got... Ah like they never forget to turn on the rear o2s.

In the end didnt matter because there is a point at which a tune wont fix it and you will be running back and forth to the shop trying to get the thing to pass. I really tried and in the end moved my car to a non emmissions county. Fairly simple thing to do and cheaper than chasing a check engine light. They do also have low mileage waivers if you drive less than 4K miles a year.

That's what I'm trying to avoid, back and forth to the shop trying to get it to pass...A WAIVER FOR LESS THAN 4K MILES? Really, can you elaborate, as this siotuation is me...

According to Texas Dept of Public Safety (AKA Highway Patrol or State Police),
the waiver is actually for less than 5000 miles per year, see this link to the Tx DPS website:

This site has all sorts of emissions waiver information, including the low mileage waiver. The low mileage waiver is pretty far down on this page, but I qoute:

"Low Mileage Waiver

There is a low mileage exemption for motorists who drive less than 5,000 miles/year. To qualify for this exemption you must:

1. Fail both the initial test and free retest
2. Incur $100 of emissions related repairs
3. Drive less than 5,000 miles/year

If you meet these qualifications then you would qualify for the low mileage waiver. Contact the DPS challenge station in your area for more information on the forms to complete."


Since the DPS administers, oversees, and actually enforces emissions testing in Texas, I know that this information is accurate and correct.

JIM...that's awesome, thanks...Wonder if I could claim new axle-backs as "emissions related repairs", lol...that's the only way I can see to meet qualification #2...I really appreciate the link, and will be looking into this further.

I am not certain, but for #2, I think that repairs mean money spent so try to fix a fault that caused your car that failed the sniff test.

So, if you replaced your axle back exhaust in between the initial sniff test and the free retest because the axle back exhaust components are thought to be the cause of the failure,that might count towards the $100 repair cost.

Don't quote me on this because I am not sure.
