I believe that you will be ok in Texas as long as you are not showing a MIL (Check Engine or Service Engine Soon) on a 1996 or newer. Here is a link to the State's explanation of OBDII emissions testing. http://www.txdps.state.tx.us/vi/misc...ii.htm#Reasons
As far as the cold air kit, it sometimes depends on the tech that inspects your car. Many of them don't really seem to know what is required, and they will try to fail you for anything that looks aftermarket. If this is the case, try another shop.

They'll hook you up and see if you throw any codes. If your rear O2's are disabled you will...and fail. You'll need an 'emissions' tune for sure. Can't remember if they sniffed my tailpipe. They will likely just see if you throw any codes, check your equipment (lights, horn, wipers, etc) and throw the sticker on. No need to go through the trouble of returning to stock. Also, if you fail you can go back to the same place that failed you within three days for another inspection free of charge.
