The BBB ain't gonna do **** for you. They're more or less just a registry of complaints. Ask him politely if he wants to fix it or if you should get an attorney involved.

I would run it a couple of days and see if it still is doing it. There should be some assembly lube in the cylinders that needs to burn off. Plus you could have some oil in your exhaust from before you had the engine rebuilt. If it's still doing it after some break in miles take it back and have the shop fix it.
