Default A little help please

Ok so about a 3 weeks ago i had a wreak that led to having to replace the rear end housing. I got my car out of the shop yesterday, and the pinion gear broke today when i was driving home from school, which is about 200 miles. (they used my gears from my old housing but they only had about 3000 miles on them). so my question is should they be the ones to cover the cost of rebuilding the rear end again? I've had a few people tell both ways but i really don't know what to think anymore.

Did you approve re-using the old gears? Did you ask them to do so?

Did they make any statements that they could, should or shouldn't be used; or that "they would be OK" or whatever?

It's probably the shops fault, but they are likely going to pull the "No warranty on used parts" bit.

I don't know, if I had a "wreak" that damaged the rear axle housing so that it had to be replaced there's no way it would go back together with the same pinion--actually the same gearset...

I asked them if the gears where fine then go ahead and use them. When they took it apart they told me all that of the insides were fine, so they went ahead and re used them. i didn't sign any paperwork but i did give them the go ahead. the "wreak" wasn't too bad i avoid the bigger wreak ( two cars collision happened right in front + slick roads dont mix very well ) but in the process i curb check the hell out of my car and broke one of the rear axles and in the process it bent the outer lip of the housing and therefore need a new housing.
