Depends.
ZW doesn't have to worry about it, if I remember correctly, Tenesee doesn't have inspections, etc.
Arizona, Carbed wouldn't work in some cities, but if I moved 100 miles north, or even got a PO Box in a town called Oracle, I'd be Emissions Exempt.
There are tons of ways to get around it.
Also, except for California, you can actually run EFI on a pushrod engine and it's perfectly legal.
An EFI 408W would be legal almost everywhere, whereas a Carbed would only be legal if registered in certain areas.

Why not?
We don't have emission testing in south carolina if thats the reason.

You can find them quite readily in most local junk yards. Ask Sexynerd what that search engine is for Junkyard parts is.

I know what site your talking about, what cars were these found in though? And if i was going to go this route is it pretty much just dropping in the engine once I build it, or is there more to it? I imagine theres more to it?
