Technically it's not an accident. Accidents have to be, well, accidental. If someone did it on purpose then it's considered Criminal Mischief (or whatever your particular state calls it.) Accidents are a civil process. Criminal Mischief is a criminal offense. Either way, he is responsible for it and his insurance should have covered it. If not then the courts would usualyl demand restitution when the criminal charge is brought before a judge.

Of course, that only works if the police do something about it. But you can still easily win a civil trial.

well i only read the first 2 posts. But this one time this guy in a van hit and ran my car and damaged my drivers side tail light and part of the bumper. I got his plate number and the insurance company gave me more than what I needed to fix it.

I had a guy driving his company truck pull out in front of me where i had to lock it up to avoid hitting him, he had his wife in the car but i still blew my horn and he flipped me off [:@] at this point i was pissed so i did a quick u-turn and chased him down got in front and slowed to a stop and had words with him... then called his company with him there.. they came and got the truck from him and terminated him right there lol (we were about 3 miles from where the shop was)

Edited just so i can say I hate how people think they own the road because they are in a truck/bmw etc.

yes , this is my question about that.

there is more to the story too, we got ou tof the car, i called the cops and he said he was leaving , and left.
so i told them he was leaving, got the info off the door, (yes it was a company truck)

BUT !! , after the dispatcher said to wait, i called the company, and it was awomans cell phone (old number maybe ?)
then i called 411 to get the number and addy of the company ( thought maybe i wrote it wrong)
and there was no such listing, this is where i got kinda scared , cuz w/ him gone and no way to find the company i didn't know what to do. and i only carry liability.

so i left to follow him. and got behind him , called the police again, they caught up to us and pulled him and myself over on the freeway.

his story was that i cut him off, and he couldn't stop in time. so the cops said they couldn't prove either way , and were finding no one at fault. i was pretty blown away to say the least.

so, YES, there is a report

NO, no ticket was issued

but, yes, there must be a record of their insurance, and addy of the company

all i know is, if i did that....i'd be rotting in jail right now

so thats what i'm thinking...having the DA file a criminal case.

anyone have any legal experience ? i might just hire a tv ad attorney too. who knows.

Yeah i'm very lucky now that i think about it, and after the fact i did feel really bad. and since i got engaged i've calmed down quite a bit. now i just let my heart race and drive on. lol

edited just to add I calmed down because now i have someone to care about and that feels great And i have learned a level head is the best route to go in anything

Honestly... Since your okay... and the Mustang didn't get TOO hurt. I would try to get some money from his carrier/company and drop it. I don't think it will be worth it for just a light and deck lid. It is a hassle to deal with all that court **** sometimes...

Dude thats really ****ty... I have terrible road rage but not as bad as others...

One day after my classes were over I was merging onto the highway in my little 95 escort and some ****bag in a old Volvo wouldent let me over, finally I got past him and went into the left lane and caught up with him while I was passing him I gave him the finger. About a minute later I see him flying up on my right shaking somthing out the window... I didnt stick around to see what it was (floored it at ducked across the inerstate in a maintnence lane) but im pretty sure he had a gun...

Some people are seriouly nutz.

Although if you cant persue him in court I would find where he lives and do a little "customizing" to his car with a ballpeen hammer...

**** that... the same thing happened to me on the way home from my dads house. some mexican (sorry if it offends) hit me the same way for not going fast enough.... he was in a mazda pickup (wft) and the cops didn't do a thing. i feel your pain, welcome to the club (member since feb. 06)

Why would that offend anyone? people from mexico are called mexicans... would you get offended if someone from mexico called you an american? Jeez, political BS has gone too far, its sad when we feel bad for refering to someone by thier proper race or origin

and to the topic, that does suck, people are completely ignorent on the roads anymore

A F%&king no-fault state....
I was on a 2 lane road turning at an intersection. I had been watching this mexican gentleman behind me for quite some time because he was tailgating me for about 6 miles.
The light turned green and i turned left into the left hand lane, the right lane had a HUGE tow truck in it.
Now i've got a class A CDL and know how hard it is to drive a heavy vehicle in urban traffic, but this tow truck driver was inexperienced. He went to make a right turn into a discount auto parts that had it's OWN TURN LANE. he cut it left right into my lane before swerving into the TURN lane.
I was driving my 1991 Toyota truck on 39" superswampers with a 9" lift (read REALLY TAll)
Well naturally with the lift I had to remove my anti-rise valve in my rear brake lines, made for great burnouts but when i hit em hard the rear end would want to lift like a mother.
I had 3 choices when he cut in front of me,
1. Hit him at 45 MPH
2. swerve onto the 1.5 foot tall median, destroy my rims and tires, and possibly spin into oncoming or passing traffic.
3. Hit the brakes and hope to all hell i stopped in time
welll.....I stopped in time.
The gentleman behind me??? nope
rear ended me at 53 mph. My rear glass shattered and I got knocked out for a couple seconds from hitting the headrest (that's what broke the glass)
when i realized what happened I noticed my truck was about 2 feet higher off the ground...
I got out...well fell out....and looked under the truck. a 1985 toyota cressida completely underneath my truck. My rear diff had hit his hood and torn a HUGE rent all the way up the hood, smashed the windshield, and peeled back the roof. the driver came stumbling out to face my outraged face and started to frantically speak spanglish. I just turned around and got into my truck, started it, dropped her in 4 low, and ROARED off his car, taking out most of the hood in the process. I pulled into the auto parts store and went straight for the tow truck driver. he was waiting for me and apologizing a mile a minute saying he had called the cops and his boss.
Well we pushed the car into the parking lot and met the cops there.
Long story short (kinda late for that) the mexican gentleman did not have insurance, a license, the car was "his brothers", he had a warrant for a missed court date, he had ANOTHER warrant for felony evasion (central florida is a no-chase zone). Needless to say he was taken to jail, and I was left in the parking lot with the cop telling me since i didn't hit the tow truck, no one was at fault. However the truck driver was cool and so was his boss, so i got new rear springs, a diff cover, and rear rims (the tires amazingly didn't bust).
Sorry about your car man....

if it makes anyone feel better i walked out of wal-mart and there was a shopping cart smashed into the middle of my driver side door. the spot i was in missed there"camera" by about 5 spots they have no idea who did it and where it came from... thanks walli-world!!!that does suck about your car! sorry to hear the bad news!
