Default Mustang Vs Bicycle..

Hey I was at a stop when a bicylist ran into me on my right side he was ejected from his seat and landed in my windshield. The bicyclist sustained minor lacerations to his left shoulder and refused medical attention at the scene and is now demanding over $10,000 in compensation which is more than what my full coverage from allstate covers. I was stationery at a stop sign in front of the condo exit the bicyclist was riding really fast on the sidewalk in the opposite direction of traffic his bicycle collided into the right side of the mustang just above the tire causing minor body damge. The estimate at allstate was $1,087.00 and they issued me a check of $87.00 because I have a $1,000 deductible. Who do you think should be held accountable? anybody have advice or experience with similar situation? let me know.

IF you were at a total complete stop, I would say it is his fault because he hit you. Of course depending where you are the bike rider may have the right of way period. (Which is stupid. Bicyclists here in Sac run stop lights and signs ALL the time downtown. You gotta be on your toes)

Did you have the cops file a report? If so what did it say? If the report says you were at a complete stop I would guess the rider is SOL.

i would talk to the local police about the case and then find out what the state/county laws are. I would also consult with a lawyer to see if he can find case law to support your case. i had the same thing happen up here in VA and the bike rider was held at fault. I know FL is a commonwealth also and the laws are similar so look in to that, hopefully it works out for you.

the case i had was the driver was at a "T" intersection and wanted to make a right, she stoped at the white line, checked for traffic and pedistrians. she didnt see either and pulled up into the cross walk to check for cars again being as there was a long distance from the white line to the corner. when she came to a stop a bike rider pulled in to the intersection and plowed the car. the things that saver the drivers *** were
-stopping at the white line
-bike rider was on the sidewalk
-traveling on the wrong side of the road
-not pushing the walk button to get a signal to walk
-walk sign dosnet change unless you push the button
-bike rider was doing 15-20 mph on a sidewalk bec his bike was totaled n bent the cars front wheel inward
-lastly witness behind her saw the whole thing ang gave the same story in court

good luck n let us know how it goes
