Wrong, they can search without consent or a warrant if they think that there is a crime being commited. its called reasonable suspicion. If you create a suit against the officer he can say alot of things, like you were acting suspicious, your breath smelt of alcohol or weed, eyes were bloodshot etc.. If you deny to take a breathalizer on the spot they arrest you and bring you dont to take one, so basically in the end, they win.

and that's horse ****, there's no way you denying them a search with a reasonable (or even unreasonable) answer is probable cause. if so, you are around some ****ed up police forces that don't put much value on the bill of rights.

in most states probable cause can mean you picked you nose and the cop sa a bloody snot on your finger so they assume you did coke and have it on you. enough to search the car. private property rights extends beyond physicasl boundries of realestate property only when you are not endangering somebody's life or breaking the law or suspected of it.
in PA the PA fish and boat commission as well as the PA game commission can search your house or personal property including clothing that is worn without a warrant. believe me i have been deputized before to assist in the fish and boat commission in such an instance and they conservation officer was correct in his suspision. we found illegal drugs on them and in their car. i cannot go into details because of legality issues but i can assure you you are wrong on this one which i might add you are not wrong often but you are here

if you're late teens/early 20s and driving around at night, you're automagically suspicious. denying them the right to search your car is what gives them their "probable cause".
