And I thought the romeo wasnt put int till march or may of '01, maybe my car was just one of the first with the engine. HAHA a test dummy or a prototype. That or a friday built special.

The change to the aluminum crosser came halfway through 2001. Some 2001s have the plastic crossover, and some do not. For details, refer to the sticky on the intake settlement. Look at the first intake runner right behind the alternator and the t-stat housing to the right of it. If it is plastic, sucks to be you. If it is aluminum, you are good to go for the most part.
The settlement allows for reimbursement of already replaced intakes on 1998-2001 Ford Mustangs with the 4.6. They also have listed certain 1997s which are applicable as well. Granted, the settlement doesn't cover all vehicles like it should. You are not guarranteed a free intake, if yours hasn't cracked already then your warranty is extended to 75k miles (I think). Quite frankly...if I were you I would insure that it cracked soon and was repaired by Ford. Just changing the t-stat and getting the housing good and tight took care of mine.
I see the settlement webpage hasn't been updated yet, I work with FORD on fleet sales/maintenance on patrol cars, so I am privy to some information a little earlier then most.

I need to make a correction...FORD will be mailing me the check. The service manager at the dealership was getting ready to cut the check until someone in corporate advised them that it comes from a special account managed by corporate (Ford of North America). Supposedly, I will have it in 3-5 days.

Hey Jglisson how lond did it take for you to get your money from ford. I went to my dealership thursday and they send the order that said i need $735 bucks so we went through the whole process and they sent it in. so hopefully i will be recieving my money soon. How long did it take for you to recieve your money? oh yeah i only spent $250 and will be gettng $735 hip hip harey for me!! haha
