I know Canada and the states are a lot different, but if cars are reasonably modded, we have to carry special/more insurance. I think if you don't have any receipts, ur hooped. gl meng, glad to hear ur not dead, but this one is gunna be a tuffy for ya to beat imo.

Argue to the teeth to get your insurance to cover your mods(since they're suing the other ins company/driver anyhow). Whatever they refuse to cover, you take the 'responsible party' to civil court to get the rest paid for.

Case in point. Had an accident in 1992 in my Toyota Pickup. Insurance totaled it but since I had the vehicle at my house and not at some dealership/junkyard I was able to salvage all my mods before they came for it. My rule is NEVER have it towed to a stealership, always to your house. That way you can get all your personal stuff out of it before any work is done to it or its totaled. If the insurance company wants to fix it, they can send a wrecker to come pick it up, and oh your insurance should not have to pay for anything if you were the one that got hit.

Something else to verify!
First off, in your state do you have cell phone/texting while driving laws. Even if you dont, I would hire a attorney and get his cell records for the time of the accident to see if he was on the phone or texting. That would weigh heavily in your favour also.
