umm if i had to make a educated guess its that it is overheating for some reason...isnt fail safe mode to prevent the engine from burning up or somethign along those lines?

It goes into to failsafe if it detects any issue that could be harmful to the motor.

It's most likely the throttle position sensor (TPS). There is a TSB on this for other throttle by wire cars, but I don't think they have one for the Mustnag yet. The problem is exactly the same, though. Mine went bad and caused the engine to go into fail-safe mode. The car does this to protect the engine. Since the computer thinks it may not be getting accurate throttle position information, it goes into fail-safe mode. Take it to your dealer. They will diagnose the problem and fix it under warranty.
