Definitely report it to the Police, that should have been the first thing you did. Granted, there isn't many investigative routes to take with a keying and the chances of the Police finding the bastard are slim to say the least, but it is always better to have a Police report on file when making an insurance claim.
If you have full coverage insurance, it should be covered. If you make the Police report and they still don't want to pay up, talk to a lawyer about it. I bet all it would take would be the insurance company just to know that you are speaking with a lawyer for them to cough up the money.

well i'm hoping before you put touch up paint on it you took your own pictures then, because i'd be doubtful about them giving you a check without any trouble since you tampered with the scratch before having the company come out and look, why are insurance companies such bast@rds my god

Just file it. Even if you don't know who did it. You may get something out of it. You seem reluctant to do anything about it. Live with a keyed car then if you don't want to try to get it fixed for free if possible.

If you just put the touch up paint on then you can take it very easily with Varsol or any professional paint thinner/remover.
I touched up a few stone chips on another vehicle and overdid it and it looked like s**t. Put some varsol on a clean rag and only worked that area and it all came off within minutes.
