yeah that really does suck.
you should get the invisible bra.
its a clear vinyl that goes over the front bumper and fenders and protects it from stuff like that.
look on ebay and type in "invisible bra" and read on about it.

damn... that sucks... I had a cement truck come barreling off a ramp onto rt. 1 south, and BAM dirt clods flying off the truck onto my front, but luckily I was able to pass him... this was back in november, and I still have some of it plastered on my car.

you can fight this and win, the clause is a stipulation, and its from their company and not their insurance, ask for their insurance and file a claim.
all vehicles ar to have their loads secure and obviously it was not,
i have had a brand new windshield chipped from a truck, i got the same run around as you, then i just filed a claim with pictures attached and a statement filed at the police station($25.00) thats all you need then its the insurance companies turn tio either dispute the case or pay it,

actually youre in luck i happen to have my CDL (commercial drivers license) the driver is liable if his load isnt covered correctly/tied down. if the dirt came off the wheels thats unavoidable but if the driver incorrectly covered his load, the driver/and or the company are liable. dont let them bs you
