I apologize for not being more clear. Thanks for that trailor... I still don't know if you're correct but it's better safe than sorry(doing research b4 anything).

The original spec doesn't even say that:

from the shop manual:
NOTE: Do not overfill the transmission. This will cause transmission fluid to be forced out of the case.
  • Fill the transmission with the recommended fluid.
  • Make sure the fluid is 0.5 in (12.7 mm) below the filler opening for the correct fluid level. Using a tie strap, measure an inch from the end and bend it at a 90° angle, place it in the filler opening and check the fluid. Adjust the fluid level as necessary.
NOTE: This is for the original 3.8L (4.0qt) recommendation, the TSB spec of 3.0L (3.2qt) is 0.75" (19mm) below the filler...

ive read a lot of stories on the internet about changing to the proper fluid type/level helping the 1-2 and especially 2-3 shifts, but not for me. I changed it today, but little or no difference.

How many miles on it?

If the damage mentioned in the TSB has already occurred, particularly damage to the blocking rings, reducing the amount of fluid won't help much...

I figured as much, but I already had it on a lift changing the fuel filter and oil so I thought I'd give it a shot. It has 63,000, everything works perfectly except shifting quickly into 3rd at anything over 3k makes a short, loud grinding noise/feeling.

Do you still have the monkey-motion OEM shifter? Getting a more precise after market STS might help...

It has a steeda tri axe. I believe this is a new problem, but I've only had the car for a few days. But, basically cannot shift into 3rd at all without really forcing it when doing anything more than light-moderate driving. :/

No, only tr-3650. t-45 you should be able to fill until it runs out of the hole and be fine.

Make sure the shifter stop bolts are backed out all the way--they can cause problems as you described if not properly adjusted, and are not needed on the 3650 anyway...
