That blows, sorry to hear about it. And unfortunately, your insurance company can sue him all they want; collecting is the hard part. Try to talk the body shop into some small extras if you can, like fixing any minor dings, scratches, etc. Sometimes they're cool about that stuff. Worst case, looks like you're getting a new fender, repainted hood and driver's door and probably front bumper, too (all to blend to new fender), and along with that they'll buff out the rest of the car to better match the fresh panels. Hope your deductible isn't too horrible.
And yeah, I woulda just kicked his *** and told my insurance company that "I don't know how it happened, when I came back out to the parking lot it was just like that....".

Took my insurance 18 months to refund my deductible after a light runner clobbered my wife in our pickup. In that case, the other guy was insured too so it was an insurance vs insurance squabble. His car was disabled or he may have tried to run too. Slime bag tried to lie about the condition of the signal to the cop but a witness stepped up with a different account than his.
