This depends on your state and exactly what kind of "check" you are talking about.
For a visual inspection, there isn't anything you can do about it. An inspector that knows what he's looking at will see the LTs, and that's that. However, I would contend that most inspectors couldn't tell apart headers and a water pump. Headers are somewhat difficult to see on your car. The only real issue will be do you have cats? More than anything else, ,the inspector will look for cats. If you have a catted X-pipe with your headers then you're probably OK. If you don't buy a catted pipe, then you'll fail.
For a computer scan, which is the most common test, you are OK if you have cats or if you have "MIL eliminators", which are basically "fake" Oxygen sensors which trick the ECU into thinking your car has cats.
For a tailpipe "sniffer test", you will need cats in order to pass, there is no way around that.
...really, cats are the key issue here. You either need to get a catted X-pipe with your headers, or you need to be prepared to temporarily swap in a catted setup for your inspection.
