In NY, the State Troopers aren't allowed to plea bargain in court. Gov. Pataki made that law before he left office as a way to reduce overtime. Last ticket I got was an 85 in a 55 (in my STI). Yes, always ask if you can have the least possible infraction. It never hurts. He gets to nail you for something, and you get to walk away without a huge fine and points on the license and everyone is happy. Talk to the DA and see what he can do for you. If he's not willing to budge, then you may want to take it further, but it's a crap shoot. You could wing it yourself without an attorney and hope the cop never shows up, or you could get an attorney, which will probably cost way more than the ticket and a year or so of insurance rate hike. If you do decide to wing it, and the cop does show up, bring up the fact that you got a ticket and she didn't, and make it seem like she got out of it because she was smoking hot! Hell you've really got nothing to loose at this point, but I don't really think it'll matter. He has the say who gets busted and who gets off in the end. And yes, get a Valentine 1. I'm picking mine up today.
If it's a speeding violation. Fight it in court!. Request a discovery package for all the radar equipment in the buro that the ticket was issued. The radar has to be inspected and certified once a year by an outside contractor. These are rarely up to date and the judge has no choice but to throw the ticket out because they have no way to verify that the radar is working correctly. Even if the radar is up to date and 3/4 of the other patrol cars aren't you can still beat the ticket just by saying there was a great possiability that their radar equipment is faulty! I've beat the last 2 speeding tickets I've got this way. If the officer claims he was pacing you from behind,ask to see a certified calabration of his speedometer. There is no such thing so he has no way to prove his speedo was working correctly either.
And lastly NEVER EVER admit that you were speeding. That torpedos any chance you have of using the defense mentioned above. Just keep your mouth shut and say as little as possible to the offericer that is pulling you over! Or tell the officer that I'm 100% sure I was doing the speed limit. It's even better if you have a car with cruise control because you can claim you had the cruise set to the speed limit. Remember your defense is that his equipment is bad and you were actually doing the speed limit. I know this defense works becase like I've said earlier, I've used it![sm=smiley20.gif]

I've seen officers show up that have no training on using radar, no certifications for their spedometer, radar or training. It's rather embarassing for them.
The beauty of requesting the discovery package isthe officersshow up in court with the exact same package that you do. So if their up to date you'll know in advance and you still have the option of pleading the charge down to a lesser offense. I've won against a local township as well as the state police using the discovery package. I figure what do you have to lose by fighting the ticket?
The fact that she didnt get a ticket isnt going to play any role and will just make you look like a jackass. It will probably come across as you whining andit isnt going to show any proof that you were speeding or not. Plus you dont know the story. If you bring that up and he says "yes your honor I pulled them both over but I only was able to radar him and the female driver denied speeding" your whole argument is done.
Whether or not the cop shows up really depends on the agency they work for. Im a cop for Phoenix Az and it is mandatory for me to go to court. If I dont I get in trouble. Plus its at least 3 hours of overtime so theres no reason not to go. Its completely up to the officer if he wants to cite you or not. I have never written a speeding ticket, except for the illegal alien doing 105 in a 55 on a crowded highway in a ford Ranger which I just arrested.
