And it wont pass the sniff test in places like Cali where they are very strick on it, right?

Won't pass anywhere if they open the hood and see your removed it. Illegal in all 50 states.

well without the egr your computer will realize something is wrong with it and shut it off internally. It isnt the correct way to do it but I have been driving my car for about 3 months now with no tune and without an EGR and had no problems
