The government usually puts whats called a price ceiling on products to prevent such things like this. The supply of a product increases as the price increases usually because they directly related to one another. The price of a good usually will drop as the quanity demanded of that good increases. The economy has an equilibrium price and an equilibrium of the number of products produced. As well there is an equilibrium of price to quantity demanded. To put that in english, if there are less buyers for a product, the price will generally increse. The government can control this and put a max price on the good. This sounds good, but there are ways around it. Its called black marketing. The dealer will mark up the price because they know that someone will come along that can pay their higher price. This is not legal if there is a price ceiling, that would be interesting to find out. Call a loyer. Another example of black marketing is how lan lords charge a key fee along with the rent controlled by the government. They will meat with a new resident and work out a large cash deal, then the lan lord will hand over the key and still collect monthly rent on top of the key fee. It is a way for them to make money to maintain their property without the government getting in the way. Everything with money is always screwy...get used to it.

I saw a GT500 at my local dealer. A customer had it in for service as it broke down with 120 miles on the odometer. NICE!! It needed a new fuel pump.
anyway, I had my 06 GT parked next to it. I spent about 10 minutes looking at both cars and my conclusion was that there are more things I dislike on the GT500 compared to the things I do like. Certainly not a bad car, but they ruined alot of the things I love about my GT.
The dealer claimed that the markup on SVT cars is a form of gratuity kickback to the dealers to compensate them for poor sales in their other ford models. horse **** if I ever heard it.
As far as ZO6 prices, back in the spring, and just a couple weeks ago, a dealer offered to order one for me at MSRP or a little below with a 10-12 month lead time. If I want it NOW, they are 5-10K over sticker depending on what comes in, color, options, etc. The black one he has on the lot is marked as 10K over. I dont happen to like black, or navigation and stuff. But he claimed to make him a reasonable offer above MSRP. I had the feeling that for 3-5K over he would have sold it as it has been there for a month or so already and winter is coming.
But dealers are going to charge over MSRP if people are willing to pay for it no matter what until ford forces them not to. And even then there are ways around it.
Back when the E46 M3 came out, I went to a dealer and they had a new red coupe in the showroom. I asked if the car was selling for MSRP. He said, "at this dealer we would NEVER sell a NEW BMW at over MSRP". But then proceded to tell me, "but this car is actually used, it has 100 miles on it, the price for this car is 78K dollars!" real cute.

You can't blame the dealerships for asking for the markups when people come in and pay it.
If I was selling one of these cars and I had someone who would pay sticker and someone else who would give me $35K over, I wouldn't sell it at sticker.
MSRP means Manufacturer SUGGESTED Retail Price, and is also what allows the general public to buy other Ford vehicles under sticker (in addition to cash incentives). Ford won't get involved with dealerships selling over MSRP because they have already gotten their money for these cars.
If they (or the government) regulated it, you wouldn't be able to haggle on anything, and it would be a one price deal.
I don't agree with the markups as I would love to buy one of 'em, but I don't disagree with the dealerships that have these cars either. I would mark 'em up too.
