Another First Speeding Ticket

RE: Another First Speeding Ticket
AS THE COURT DATE APPROACHES:
1. Very important. DELAY, DELAY, DELAY!!!!!! Keep putting off that court date! You don't want to go to court! You want to make it so the cop thinks the case is so far in the past he'll never remember anything. A small story: When John Hussar, the director of The Blur of Insanity went to college he got a speeding ticket (90 mph in a 55 mph zone) from a New York State Trooper. He successfully put off going to court for two and a half years (mainly by lying about going on various trips to Europe)!! When he final did show up in court he discovered that the Trooper had been transferred out of the area! The case was immediately dismissed!
The Lesson? The longer you wait the better chance the cop won't show up!

I just got pulled over about 30 minutes ago for doing a 76 in a 55 which I believed to have been a 70. I was not only in the right lane but being passed by other vehicles. I was a complete gentleman with the police officer telling him it was my first time in the area and I was unaware of the speed limit and was not paying attention to how fast I was going. I apologized he acted nice came back after I had given him my license and registration and said 76 in a 55 go to court and fight it or pay the $200 fine, have a great night.
Whatever I guess, no points on my license I can do the online course just sucks I have to pay a $200 fine... [&o]

1. Get a good radar detector (Bel/Escort etc)
2. Forget the "I was just keeping up with traffic" reply. The cop will reply "yea I know, but I got you"...
3. Correct way to deal with a traffic stop is:
a: Never admit ANYTHING... The cop is a sworn court officer... Your admission is a confession....
IOW NEVER say "yea I know I was doing 80mph but...........
b: Be polite (you were)..
c: Officer, I had just passed a truck/car/suv that I felt was driving erractically. Be prepared to give a description.
and DO NOT ADMIT YOUR SPEED...You were too busy concentrating on the road to look at the speedo.
d: Officer would it be possible to give me a warning and I will be more careful in the future?
BTW if he was pacing you, you are dead...........
This works for radar speed traps only.....
Also, should you get caught in a radar trap there are many wonderful tactics you can use to win your case.
Obviously this is not worth it for a $25.00 ticket, but, if you have 5 of them and might lose your license or your insuranace premium is in danger it might be worth it.
The best defense is:
1. When was your radar gun last calibrated?
2. Was it raining/snowing/foggy etc outside. Radar is terrible under these conditions
3. When was the last time you were trained and certified on the radar equipment?
etc.......
Essentially what you are doing is delaying the proceedings and causing a lot of grief for the court.
Most times they will either offer you a deal to go away, or dismiss the charges completely.
One thing though....
NEVER EVER EVER just pay a fine.........
You can almost ALWAYS plead it down and in many cases the cop won't even show up in court.
In NY, 2 times and the case is dismissed.
They just assume YOU won't show.....
Good luck!!!
In case you are wondering, my cousin is a cop

RE: Another First Speeding Ticket
Okay, he did get me on radar and put that on the ticket. The ticket is $208.50 and i'm allowed to take the online course to take off the points. The officer was younger maybe 22-25 years old. Should I really take it to court and if he doesn't show up do I get the points off and not have to pay for the ticket? What are the chances he won't show up and just what else should I do if he does? steve gave me a few ideas but if I do go for this I don't want to get caught in a lie.

Ok.
What you have to do is check with your insurance company as to what counts as penalties.....
IOW points always count and are a bad thing.
A parking ticket usually does not....
etc......
You have to determine if they screw you for the speeding ticket, even though your points are gone due to your taking the online course.
Personally, I would show up in court, delay, delay,delay,delay..........
You have to realize that in the total scheme of things, you are small fish........
Personally, seeing as it was radar I would try the "unsafe truck, rocks spewing out the back, weaving, i had to get out of that lane etc.....story and see what happens.
They WILL ask you for speciifics of the truck in question so be prepared to anser on que....
Color/size/etc....
Explain to the judge that you had been behind that truck for a couple of miles, and it was tossing rocks and you in the past you had windshields cracked etc.....................
You were hoping it would get pulled over etc......
You made a decision to pass the truck and that's when you got clocked.
The judge will ask you, "so you were going 75mph" to which you answer" more than likely I was your honor"...
DO NOT LIE OUTRIGHT (speed, lane etc)....Just be creative with the circumstances.
Seriously, you are fighting for insurence premiums!!!

Do not just give up!!!
