bad accident

Default bad accident

so on monday night i was i290 heading west out of chicago to visit my parents when some dipsh!t in a POS 1996 toyota tercel rearended me at about 50mph. airbags went off, windshield shattered, and her hood was an accordian. f'ed up the back of my car royally...bent the frame like crazy, destroyed my rear bumper, pushed in my dual exhaust, etc. now i have a 2006 GT 5spd that is not even 1 year old...owe like $17k on it still.

do you think they'll total my car? it's obvious her car is totaled...but what about mine? i mean it IS driveable (my airbags didn't go off), but the rear exhaust is f'ed up really bad, so is the bumper, and the frame is bent. i mean crap, i do NOT want them to fix it and be like, "here ya go!" because damn, i don't want a car with frame damage. AT ALL. it will never drive the same, and i don't think it's fair. plus her shattered windshield went all over my car chipping the paint all over the place. what do you think? totaled? i know you want pics, i'll put them up ASAP...

Ditto, glad to hear that you weren't hurt. I thought the S197's were unibody, like every other Mustang... guess there is my "learn something new everyday" item.

It depends on the Laws in your State. Here in Delaware, an Insurance company can total a car if the cost to repair the car is 50% of the value of the car. And value is determined by the average of three dealers would take in cash for your car before the accident. So if the car is valued at $20,000 and repairing it would cost at least $10,000, the insurance company will total the car. And will pay you $20,000 less deductible.

I know it is frustrating, and irriatating right now,but give the insurance and/or bodyshop guys a few weeksto do theirmagic, and things will come back to normal. Hang in there Brother!

Gladno one was hurt badly.

Have you got an estimate ? Have you spoke with an adjuster ? What insurance did she have ? Have you contacted your insurance co ?

actually, i was hurt quite a bit. my back is f'ed up royally, i have a lower back strain, my arms are ****ed up from broken glass, and my head and upper neck hurt from whiplash. they are seeing if i have a concussion. the a-hole that hit me is 100% ok. damn her and her airbags!

anyway, i cant believe my frame is bent...this sucks. hopefully the damage is > $10,000 and they will total the car. at least i can hope... :-D

don't know what the laws on this are in illinois. any way to find out?
